Agreement to Terms

By accessing or using the website sunstonesoft.com and services provided by Sunstone Soft ("we", "our", or "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our website or services.

These terms apply to all visitors, users, and clients of Sunstone Soft.

Services

Sunstone Soft provides web design, web development, website hosting, website maintenance, and related digital services to businesses in Calgary, Alberta and surrounding areas.

Specific services, deliverables, timelines, and pricing are outlined in individual project agreements or quotes provided to clients. These project-specific agreements form part of these Terms of Service.

Client Responsibilities

When engaging our services, you agree to:

• Provide accurate and complete information required for your project
• Provide content, images, and materials in a timely manner
• Review and provide feedback on deliverables within reasonable timeframes
• Ensure you have the rights to any content you provide us
• Make payments according to agreed-upon terms
• Communicate any concerns or issues promptly

Payment Terms

Payment terms are specified in individual project quotes and agreements. General terms include:

• A deposit may be required before work begins
• Final payment is due upon project completion, before website launch
• Hosting and maintenance fees are billed monthly or annually as agreed
• Late payments may incur additional fees or service suspension
• We accept e-transfer, credit card, and cash payments

All prices are in Canadian dollars (CAD) unless otherwise specified.

Intellectual Property

Your Content

You retain ownership of all content you provide to us (text, images, logos, etc.). By providing content, you grant us a license to use it for the purpose of completing your project.

Our Work

Upon full payment, you receive ownership of the custom website design and content created specifically for your project. This includes:

• Custom design elements created for your project
• Custom code written specifically for your website
• Content we create on your behalf

Third-Party Components

Websites may include third-party components (frameworks, libraries, plugins) that are subject to their own licenses. These remain the property of their respective owners.

Portfolio Rights

We reserve the right to display completed projects in our portfolio and marketing materials unless otherwise agreed in writing.

Website Hosting

For clients using our hosting services:

• We strive for maximum uptime but cannot guarantee 100% availability
• We perform regular backups but recommend clients maintain their own backups
• Hosting fees must be paid to maintain website availability
• We reserve the right to suspend hosting for non-payment or terms violations
• You may transfer your website to another host at any time with reasonable notice

Revisions and Changes

Project quotes typically include a specified number of revision rounds. Additional revisions or changes outside the original scope may incur additional charges.

Major changes to project requirements after work has begun may require a revised quote and timeline.

Project Delays

Timelines provided are estimates based on timely client feedback and content delivery. Delays caused by late client feedback, content, or approvals may extend project timelines.

If a project is delayed for more than 30 days due to client inaction, we reserve the right to invoice for work completed to date and/or charge a reactivation fee to resume.

Cancellation and Refunds

If you need to cancel a project:

• Deposits are generally non-refundable as they reserve our time
• You will be invoiced for all work completed to date
• Any completed deliverables will be provided upon payment

We reserve the right to cancel projects if terms are violated or if the working relationship becomes untenable. In such cases, you will only be charged for work completed.

Limitation of Liability

To the maximum extent permitted by law, Sunstone Soft shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services, including but not limited to:

• Loss of profits or business
• Loss of data
• Website downtime
• Third-party actions or services

Our total liability shall not exceed the amount paid by you for the specific service giving rise to the claim.

Warranties and Disclaimers

We provide services with reasonable skill and care. However:

• We do not guarantee specific search engine rankings or business results
• Websites are provided "as is" after client approval
• We are not responsible for content accuracy provided by clients
• Third-party services (payment processors, email providers, etc.) are subject to their own terms

Acceptable Use

You agree not to use our services for:

• Illegal activities or promoting illegal content
• Harassment, defamation, or discrimination
• Distributing malware or engaging in hacking
• Spamming or phishing
• Infringing on intellectual property rights
• Any activity that could harm our reputation or systems

We reserve the right to refuse or terminate services for any content or activity we deem inappropriate.

Governing Law

These Terms of Service are governed by the laws of the Province of Alberta, Canada. Any disputes arising from these terms or our services shall be resolved in the courts of Alberta.

Changes to Terms

We may update these Terms of Service from time to time. Changes will be posted on this page with an updated revision date. Continued use of our services after changes constitutes acceptance of the new terms.
